The Bastrop Police Department responded to a call at the Morehouse Magnet School in reference to a handgun being found on a child on Feb. 8th.
The weapon had already been secured by the faculty at the school before police arrival.
The child was 9 years old.
Title 14:13 states: “§13. Infancy. Those who have not reached the age of ten years are exempt from criminal responsibility. However, nothing in this article shall affect the jurisdiction of juvenile courts as established by the constitution and statutes of this state.”
Due the child’s age, he was not placed under arrest at this time.
The case file has been forwarded to the District Attorney’s Office and the matter remains open at this time.
The investigation is ongoing.
